The Department of Environment and Science has just released Procedural Guides that assist in determining the lawfulness of releases to waters which now available through the department’s website; https://environment.des.qld.gov.au/management/water/urban-stormwater/erosion-sediment-control/_nocache

These Procedural Guides are designed to provide officers, authorised under the Environmental Protection Act 1994 (EP Act), with a tool for undertaking erosion and sediment control (ESC) compliance inspections and guidance to apply enforcement provisions under the EP Act. Please note that the Procedural Guides do not limit the discretion that authorised officers are required to exercise. The department’s Enforcement Guidelines provide broader guidance on the department’s approach to compliance and enforcement for all legislation under its jurisdiction.
